Contractual Service

Online Personalized Workout Plan

The contractual service includes online personalized workout plans and ongoing online support from a certified personal trainer. During the program, one-week workout plans will be delivered every four weeks via a mobile phone application. Each one-week workout plan includes 3–6 training sessions per week, which are recommended to be repeated weekly for four weeks.

You can purchase our services through a reseller (merchant of record).

The total price for the program, excluding taxes, is 99 USD a month or the equivalent in local currency. In Hungary, the total price for the program, including taxes, is 125.73 USD a month (99 USD a month + 27% VAT) or the equivalent in local currency.

The service provider reserves the right to offer discounts, either periodically or individually, on the total price of the contractual service, including taxes.

The personalized workout plan is exclusively designed for personal use by individuals over the age of 16, and is created based on the principles published on the service provider’s website and the information provided by the consumer, tailored to beginner and intermediate levels.

The personalized workout plan is not suitable for fitness and sports professionals for addressing needs arising from their professional activities (e.g., trainers providing workout plans for athletes) and is not intended for advanced, competing, or professional bodybuilders.

Persons under the age of 16 cannot order the personalized workout plan service.

The personalized workout plan is created exclusively in writing, through the service provider's website, email, and mobile application. No personal meetings, in-person assessments, health evaluations, phone, or video conferencing consultations are conducted during the preparation of the personalized workout plan.

The personalized workout plan is recommended only for those whose health condition allows them to safely perform any gym exercises and who do not have any health precautions or contraindications (e.g., heart disease or high blood pressure, chest pain, dizziness, or fainting within the past year, chronic illness or medication, injuries to bones, joints, muscles, tendons, or ligaments within the past year, pregnancy). The personalized workout plan is not a medical or personal training service. The service provider is unable to accommodate the consumer's individual health requirements. In case of any precautions or contraindications, it is the consumer's responsibility to consult their healthcare provider in advance and to follow their advice when exercising.

The personalized workout plan is for informational purposes only. Determining its suitability for the consumer’s goals, physique, fitness level, and health condition and finalizing it through any necessary further customization is the consumer's responsibility.

Before ordering the personalized workout plan and before starting the exercises in the event of an order, it is the consumer’s responsibility to assess their health condition, ensure the correct, safe, and health-appropriate execution of the exercises, and seek medical advice if necessary.

Nutrition

The service provider only provides general, informational guidance on adopting healthy, varied, and effective dietary habits. The service provider is not a dietetian and does not create custom meal plans.

The general nutritional guidelines are intended only for healthy adults and are not applicable during pregnancy or breastfeeding. These guidelines are particularly not recommended for conditions such as diabetes, eating disorders, or gastrointestinal diseases.

It is the user’s responsibility to develop a diet suitable for their own condition based on the nutritional guidelines, with the assistance of a dietitian or physician if necessary.

Terms of Use

The user may use the contractual service exclusively for personal purposes and may not share it, in part or whole, with third parties, copy it, or reproduce it.

The services provided by the service provider are delivered by an NASM International Certified Personal Trainer (ICPT) within the scope of practice defined by the service provider here. By accepting these terms, the consumer agrees that the service provider is capable of delivering the contractual service with the expected outcome, without any additional expectations regarding the service content. The user may not use the contractual service for purposes exceeding these professional qualifications or the defined scope of practice, and no claims may be made against the service provider for such use.

The services provided are considered consulting services for private individuals with regard to nutrition and food products, movement, fitness and sport, covered by professional liability insurance. The consumer is obligated to use the service only as intended, such that its use is considered consulting service for private individuals under the Exali Professional Indemnity for Digital Professions professional liability insurance policy.

Conditions of Fulfillment

Fulfillment requires the consumer to pay the full price of the service, including taxes, and use the mobile application recommended by the service provider.

The personalized workout plan is delivered through the mobile application within three days of meeting the fulfillment conditions and subsequently every four weeks.

If the data provided through the mobile application is incomplete or incorrect, the workout plan may not be fully personalized.

Complaints may be submitted by email. Complaints will be investigated within 30 days, and the consumer will be informed of the results via email.

Right of Withdrawal and Termination

The consumer is entitled to withdraw from or terminate the contract without justification within 14 days from the day the contract is concluded, except when the consumer requests the service provider to begin the fulfillment of the service before the 14-day deadline expires and acknowledges that upon the fulfillment of the service, they will not be able to exercise their right of withdrawal and termination.

To exercise the right of withdrawal or termination, the consumer may submit an unambiguous statement or use the following withdrawal/termination form by sending it via email.

Conciliation Board

Consumers may turn to a conciliation board.

The conciliation board relevant to the service provider's registered office is the Budapest Conciliation Board in Hungary (Budapesti Békéltető Testület), with its postal address at 1016 Budapest, Krisztina krt. 99. I. em. 111., Hungary.
